Privacy Policy For Website Visitors From Canada

Your privacy is important to Keter Canada Inc. (“Keter”, “we”), and we are committed to the careful handling of personal information about customers and other individuals (collectively “you”). Our privacy policy (“Privacy Policy”) is intended to explain how Keter collects, uses, and discloses the information you provide to us, when using our websites (the “Keter Websites” or the “Websites”), purchasing Keter products and services (collectively, the “Keter Products”) or which we otherwise collect in providing the Keter Products to you, including any personal information (“Personal Information”). When we use the term Personal Information in this Privacy Policy, we mean information which enables us to identify a natural person, directly or indirectly, by reference to an identifier such as a legal name, location data, or other identifier specific to his/her physical, physiological, genetic, mental, economic, cultural, or social identity. By using the Keter Websites, you understand that we may collect your Personal Information as described in this Privacy Policy. 

Applicability & Scope 

This Privacy Policy is incorporated into the Terms & Conditions which apply to all visitors from Canada to Keter’s Websites. For individuals in the United States, please refer to Keter.com.

This Privacy Policy describes our policies and procedures regarding the collection, use and processing of Personal Information through all Keter Websites and online resources or applications offered by Keter. 

Your use of the Keter Websites constitutes consent to the processing of any Personal Information as described in this Privacy Policy. 

Collection of Personal Information 

In order to provide and continually improve Keter Products and the Keter Websites, we collect information which may include Personal Information. Our collection practices are intended for interaction in the business environment. In most cases, you will voluntarily provide your Personal Information. For example, we collect personal information through your registration for an account and purchase of the Keter Products; when you use or visit Keter Websites; when you participate in a Keter sales event. We may also receive Personal Information from our third-party partners. If you are a Keter partner or supplier, we may also collect your personal information. If you have other agreements with Keter, then those agreements control with respect to their subject matter. 

We also collect information that you voluntarily provide by subscribing to Keter marketing communications, registering for events, or providing testimonials for our use on our Websites or other promotional materials. Information you directly provide to us include your personal identification data (for example, name, surname) and contact information (phone, email, address, country). Additional transaction and billing information is also required when procuring Products. 

When interacting with Keter, please keep in mind that Keter does not solicit, does not require, and you should not disclose to Keter, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership). 

The type of Personal Information that we collect depends on your interactions with us and may include: 

  • Contact Data. Name, employer, job title, business email address, physical business address, phone number, and similar contact information. 
  • Log In Data. This can include user names and tokenized passwords. 
  • Payment Data. Credit card number, bank information, and billing address (if purchasing via credit card). 
  • Registration Data. Product registration information, product interest information, transaction information.  
  • Geolocation Data. Keter sometimes collects geolocation data to provide you with enhanced information, based on your purchase of the specific Keter Products. 
  • Devices, Usage and Transactional Data. We collect data related to how you access and use our Websites, and we analyze that usage data so we can improve the Keter Products and your experience with the Keter Websites. Usage data may include information about your computer or mobile device’s operating system and browser type; your device type; details about how you are using Keter Websites; your Internet Protocol (IP) address; browser type and networking connection information; cookie information; file information; metadata; time stamped logs regarding access times and duration of visits; website visited before coming to a Keter website, including pages you request, and other clickstream data. 
  • Third Party Data. Keter may receive your Personal Information from third parties, including our suppliers, vendors or partners. If you connect with Keter accounts on third party websites or social media sites (such as Facebook), then we may receive information about your social media accounts, for instance, your name, user name, public profile, photos, and email address. We may combine the information you provide with information that we collect automatically, and with data that we receive from third parties. If you choose the option of connecting with a Keter Website through your social media account, then you will be required to approve the connection as well as the provision of information (which may include personal information and other information, such as your profile picture, gender, birthdate, headline, social media handle, summary that appears in the profile, friends’ lists, previous positions and organizations, etc.), that we obtain from your third party account. Any data submitted to any third party account, even on and through the Keter Websites, is managed directly by such third party and is not the responsibility of Keter. The third party account may connect your visit to our Websites with your Personal Information using cookies, web beacons, and device identifiers. The information collected can include Personal Information about your online activities over time and across different websites, devices, online channels and applications. 
  • Images, Videos, and Recordings. We may collect pictures, videos, or audio recordings of you. For example, if you attend a Keter event, your image may be captured in a photo or video from a CCTV camera; or if you call Keter Support, we may record the call after providing appropriate notice to you. 
  • Job Application Data. We also collect Personal Information relating to employees, contractors, and employment candidates, including name, address, email address, telephone number, resume information, notes on meetings, standardized tests, reports, references, interviewer impressions and other industry standard data, as well as data made publicly available or available to us from social networks. We collect Personal Information that is customary or necessary to administer contractor and employee engagements and the employment relationship. If a job candidate or employee resides in a jurisdiction in which we are required to provide a separate privacy notice for job applicants, our collection and use of the Personal Information will also be governed by such separately-provided privacy notice which shall prevail in the event of any conflict between the terms of such notice and the terms of this Privacy Policy.  

The above Personal Information we collect fall into one of the following categories: 

  • Government identifiers and other Identifiers; 
  • Commercial information; 
  • Internet or other electronic network activity information; 
  • Geolocation data; 
  • Financial information; 
  • Professional and employment related information; 
  • Education information; 
  • Inferences drawn from any of the above. 

How We Use Your Personal Information 

We use the Personal Information we collect for the purposes described in this Privacy Policy, and as covered in any agreement that incorporates this Privacy Policy (“Agreements”), or as otherwise disclosed to you in connection with the Website. For example, we use Personal Information to: 

  • To collect and process payments and facilitate payments through third party payment processors, including collecting credit card information and other billing information. (Please see the privacy policy of our integrated payment providers: Adyen at www.adyen.com, PayPal at www.paypal.com
  • Direct marketing. We may send you direct marketing communications, by email or otherwise, where and to the extent permitted by law. See below for information on how to stop receiving direct marketing communications. 
  • Tailored advertising. We may engage our advertising partners, including third party advertising companies (such as Google and Microsoft) and social media companies (such as Facebook), to customize the content displayed to you on the Websites, and to display ads across the Internet. 
  • Provide and deliver our Products. 
  • Maintain and improve our operations, systems, Products, and services. 
  • Understand your preferences to enhance your experience. 
  • Respond to your questions and comments and to provide customer service. 
  • Provide service and support, such as sending confirmations, invoices, technical notices, updates, security alerts, administrative messages, and providing support and troubleshooting. 
  • Communicate with you and for referrals regarding any promotions, upcoming contests and events, and news about Products and services offered by Keter and selected partners. 
  • Link or combine information about you with Personal Information that we receive from third parties to help understand your needs and provide you with better and more personalized services. 
  • Enforce our terms and conditions, or protect our business, our partners, or our users. 
  • Detect, protect against, investigate, and deter fraudulent, unauthorized, or illegal activity. 
  • Comply with legal process and other lawful requests, and verification requests in connection with internal and external audits. 
  • We may share information with our affiliates and subsidiaries from time to time (whether wholly or partially owned by Keter) (“Affiliates”), which may be located in the European Union, Israel, United States, and elsewhere, to manage our business more effectively and for such affiliates’ own marketing and other purposes
  • For any other purpose disclosed to you in connection with our Website or Keter Products 

The Lawful Basis on Which We Use Your Data 

We typically collect or use Personal Information only where we have your consent to do so, where we need the Personal Information to perform any of our Agreements with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may have a legal obligation to collect or retain Personal Information or may need the Personal Information to protect your vital interests or those of another person. In offering the Keter Products, we rely on the following legal bases for the processing of Personal Information: 

  • To fulfill our responsibilities under the Agreements and to provide you with the Keter Products. 
  • Any legitimate reason to collect and use your information, including, but not limited to, gathering usage data which can include Personal Information to improve our Products and services, advising you about changes to this Privacy Policy or other Keter policies; or promoting Keter events and Products, offers and promotions. 
  • Your consent to the use of your Personal Information, in which case you can withdraw consent by using the contact information included below. 
  • The necessity for Keter to comply with a legal obligation, or to establish, exercise and defend Keter from a legal claim. 
  • The necessity to respond to your requests. 
  • That you made your Personal Information public, for example by publicly posting on social media. 
  • Any other legal basis as permitted by applicable law 

How We Secure Your Personal Information 

Data security is very important to Keter. We use appropriate technical and organizational measures to protect the Personal Information that we collect and process about you against accidental or intentional manipulation, loss, destruction, or other unauthorized access or disclosure. The measures we use are designed to provide a level of security appropriate to the risk of processing your Personal Information, but we cannot guarantee the absolute safety of Personal Information. How We Share Your Personal Information 

It is important to Keter that we keep your Personal Information secure. In some circumstances and subject to compliance with applicable law, Keter may share your Personal Information with third parties, for example: 

  • With your consent. Keter may share your Personal Information when we have your permission and consent, including when you choose to comment on or otherwise post information on Keter social media sites. 
  • Business partner services. We share information with our trusted partners who work on behalf of Keter to provide us with services. For example, we may share information with our certification partners, our transport service providers, customer support, and marketing vendors, payment processors, and software providers. These companies may use your Personal Information to perform services and to help Keter communicate with you about offers from Keter and our marketing partners. We maintain contracts with these companies that restrict their access, use and disclosure of Personal Information in compliance with this Privacy Policy and any legal obligation. 
  • Third Party Accounts. You may connect to third party accounts through the Keter Website and partner ecosystem, and we may share some Personal Information with those third-party services. For example, information may be shared to authenticate you, or we may share your username and your preferences in connection with those services. These third-party accounts and services are not owned or controlled by Keter, and they may have their own policies and practices for the collection and use of Personal Information. Please review the privacy policies of those third-party accounts to understand how they use your information. 
  • Merger, sale, or other business transfer. We may disclose information as part of a proposed or actual reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or a portion of Keter’s business, assets, or stock; or in the event of insolvency or bankruptcy. 
  • For legal reasons. Keter may disclose Personal Information if we have a good-faith belief that the access, use, preservation or disclosure of that Personal Information is reasonably necessary to: comply with any applicable law, regulation, legal process, or enforceable government request; enforce our Terms of Service, Agreements or any other applicable policy or agreement; detect, prevent, or otherwise address fraud, security or technical issues; or protect against harm to the rights, property, or safety of Keter, our users, or the public as required or permitted by law. 
  • Aggregated and de- identified data. We may share de-identified data (i.e. data that can no longer be linked to an individual person) with others for a variety of purposes. For example, we may share data to show trends or benchmark performance indicators. 

We may facilitate third party services or ways to share data through third parties, including social media platforms, websites, applications, and services through “plug-ins,” widgets, buttons, and other third-party features on and connected with our Website, communications, or products. Third parties whose services you use in connection with Keter, for instance third party websites we link to, may have information practices that are different than ours. This Privacy Policy does not apply to the activities of third parties when they are collecting or using data for their own purposes or on behalf of others. We are not responsible for the activities of these third parties. We encourage you to review their privacy policies to understand how they use your information. 

Cookies, Web Beacons, and Analytics 

Like many companies, Keter uses cookies and similar technologies, like web beacons and pixel tags, to collect additional information. Cookies are small files that may be downloaded onto your device. When you visit a Keter website again, the cookie allows that site to recognize your browser. Cookies may store preferences, like language, as well as other information and settings. Web beacons and pixel tags are small pieces of code placed on a web page or within the body of an email in order to collect data about the visitors viewing a web page or opening an email.

We use a variety of analytics tools, including Google Analytics, Microsoft analytics tools, and Lucky Orange Services analytics tools. Analytics tools help website and app owners like Keter understand how visitors engage with our properties. We also use Google signals, which collects session data from sites and apps that Google associates with users who have signed in to their Google accounts, and who have turned on ads personalization in their Google settings, in order to enable cross-device reporting, cross-device remarketing, and cross-device conversion export to Google Ads. In addition, we use Microsoft Advertising to advertise our products and services across the web, and we use Microsoft Clarity to analyze website usage. From time to time, we also partner with third parties who may place cookies on your browser when you visit our websites, and may use those cookies to provide track and collect information about you and your online activities over time and across different websites, devices and applications, and to offer advertising based on your interests and previous browsing history. 

We do not place non-necessary cookies without your consent. Cookies identify the device from which you connect and in some cases could be used to identify you. Different cookies that we use are kept for different periods: Session cookies are used to keep track of your activities online in a given browsing session; these cookies generally expire when the browser is closed but may be retained for a period on your device. Permanent cookies remain in operation even when you have closed the browser. Some cookies are necessary as they are required for the operation of the Sites, such as cookies that enable you to login to secure areas. You cannot opt-out of necessary cookies; however, we will not place non-necessary cookies on your device without your consent. You can consent to cookies through the Cookie Preference Tool available on some of our Websites, and you can withdraw consent using the same tool. The cookie preference tool is device and browser specific. If you delete or clear cookies or change devices or browsers, you will need to reset your cookie preferences using the tool. In addition, you may use your browser settings to delete and reject cookies. However, erasing or not consenting to some types of cookies, through the tool or your browser settings, may limit your experience on the Website and the services we are able to offer. Non-necessary cookies include functional cookies which are used to recognize you when you return to our Websites, and enable us and our third party partners to personalize content to your preferences. 

Tailored Advertising and Opt-out Options.  

With your consent, we permit third parties to use cookies and other tracking technologies (such as web beacons and pixels) with the aim of collecting certain information to analyze behavior and customize the content displayed to you on the Site, as well as to provide you with advertisements tailored to you across the Web. SMS Messages and Cancellation. 

If you are an employment candidate, we may from time to time give you the option to engage with us in SMS text messaging about your job application. By opting into such SMS conversations, you understand that message frequency may vary depending on the status of your job application, and that message and data rates may apply. Please consult your carrier for further information on applicable rates and fees. Keter is not liable for delayed or undelivered SMS messages. You may reply STOP to cancel and HELP for help concerning receiving SMS messages.. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. 

Do Not Track.  

Keter does not respond to web browsers’ “do not track” signals. While some internet browsers offer a “do not track” or “DNT” option that lets you tell websites that you do not want to have your online activities tracked, these features are not yet uniform and there is no common standard that has been adopted by industry groups, technology companies or regulators. Therefore, we do not currently commit to responding to browsers’ DNT signals with respect to our websites. 

Unsubscribe from Emails.  

Any marketing emails we send will include an automated way for you to opt out (unsubscribe) from that marketing email distribution sent by us. To unsubscribe, please follow the instructions in the email you receive. You may still receive non-marketing emails for us, for example communications about orders you have placed with us or responses to your inquiries. 

Right to Know. 

You may have the right, depending on your jurisdiction, to request the following about the Personal Information we have collected about you: the categories and specific pieces of Personal Information we have collected about you; the categories of sources from which we collected the Personal Information; the business or commercial purpose for which we collected the Personal Information; the categories of third parties to whom we sold or with whom we shared the Personal Information; the categories of Personal Information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed that information for a business purpose; the specific pieces of Personal Information about you that we collected, disclosed to third parties for a business purposes, sold to and/or shared with, third parties; the right to receive requested information in a readily-usable format if provided electronically; and the right to update or correct any Personal Information which is out of date or incorrect 

Data Retention and Right of Access. 

We will retain your Personal Information for as long as your account is active or as needed to provide you services. We may also retain Personal Information in order protect our legal rights, comply with the legal requirements, or comply with record keeping requirements. We keep the data that we process on behalf of customers in accordance with our customers’ instructions. Where appropriate or necessary in light of the nature of the data in question and the risks to data subjects, we may encrypt data. Note however, that no data security measures are perfect or impenetrable, and we cannot guarantee that unauthorized access, leaks, viruses and other data security breaches will never occur.  

If you wish to request that we no longer have access to or the right to retain or use your information, contact us atprivacy@keter.com. Please keep in mind that we may need to keep your data to comply with our legal obligations, resolve disputes or enforce legal agreements. 

To the extent permitted by applicable privacy laws, we may also deny a deletion request if retaining the information is necessary for us or our service provider(s) to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities. 

Data that is no longer retained may be deidentified, aggregated, pseudonymized or anonymized or deleted. Likewise, some metadata and statistical information concerning the use of our services are not subject to the deletion procedures in this Privacy Policy and may be retained by Keter. We will not be able to identify you from this data. Some data may also be retained on our third-party service providers’ servers or backups until deleted in accordance with their privacy policy and their retention policy. Personal Information may also be retained in our backups until cycled out and overwritten. 

You have rights to access and update the Personal Information Keter has collected about you. You can usually do this using the settings and tools in the relevant Keter Website or account. Otherwise, you may contact Keter’s Privacy Officer at: privacy@keter.com.

Right to Opt-Out of Sales and/or Sharing of Personal Information 

Keter does not charge a fee for sharing any Personal Information collected from you. However, sharing your Personal Information may be considered a “sale” any time a business makes available any Personal Information to a third party for other valuable consideration, such as for preparing analytic data or marketing plans based on Personal Information or other business purposes as outlined above. 

You may request Keter to refrain from Selling your Personal information by visiting our Do Not Sell or Share My Personal Information link or by calling us toll free at 1–888–374–4262. To help protect your privacy and maintain security, we may take steps where required to verify your identity before granting you access to your personal information or complying with your request. We may not be able to respond to your request if we cannot verify your identity. 

Right to Opt-out of International Data Transfers  

This Privacy Policy is intended to apply to our operations in Canada. Users outside of Canada should use the websites of our affiliated entities intended for operations in those jurisdictions. Information provided on our Websites in Canada and in jurisdictions outside of Canada will be transferred to and processed in Canada and the United States.By providing us your information, you consent to the transfer to and processing of your information in Canada and the United States. We make no representation that the practices described in this Privacy Policy are compliant with laws outside of Canada that apply to the collection, security, use and disclosure of information. When information is transferred to Canada, it will be handled in accordance with the laws of Canada. If you are located outside Canada, please be advised that some jurisdictions, such as the European Economic Area, do not consider the privacy protections in Canada to be adequate at this time. We and our service providers may transfer Personal Information to, and process such information in, multiple locations globally. By using our Website you consent to such international transfers. 

For unresolved privacy or data use concerns, Keter has elected to cooperate with Data Protection Authorities (DPAs) and will cooperate with DPAs in the investigation and resolution of complaints.  

If you elect to withdraw your consent to Keter’s international transfer of your Personal Information, please contact Keter Canada’s privacy officer at: privacy@keter.com Please be aware that in the event of such withdrawal of consent, Keter may not be able to complete transactions for your purchase of Products or complete other transactions with you. 

Opt-Out of Marketing Materials

Refusal or Withdrawal of Consents; Exceptions to the above Rights 

If you decline to provide your Personal Information or ask us to delete it or refrain from sharing it, we may be unable to conclude transactions for the sale of our Products to you or unable to continue communicating with you. We may also be unable to provide after-sales services to you for Keter Products you may purchase. 

The law also provides for certain exceptions to your rights of refusal or withdrawal of consent to Keter’s right to access, retain, or share your Personal Information as described herein. We reserve the right to avail ourselves of these exceptions where available.  

 

How to Contact Us for Assistance with Access, Modification, Withdrawal. 

If you would like assistance in the exercise any of your rights to access Personal Information collected by Keter, to opt-out of such collection, to refuse consent for the transfer or sharing of your Personal Information, to edit, modify, update or otherwise change Personal Information we have collected of you, please contact us at privacy@keter.com. In your request, please describe the nature of your request, the Personal Information it relates to, and we will comply as soon as we reasonably can, and consistent with applicable law. Whether and how the right applies will depend on the applicable law, and in some situations the Personal Information is exempt from such requests. To the extent that your request includes certain types of Personal Information necessary to provide the Keter Products, if you request the deletion of that Personal Information, you may no longer be able to access or use the Keter Products. 

Links to Third Party Platforms 

The Keter Website may contain links to third party websites, online services, or social media platforms. The fact that we link to a website is not an endorsement or indication of affiliation with that third party website. We exercise no control over third party services or websites, and third-party services and websites have their own privacy policies, which may be different than ours. 

This Privacy Policy does not apply to third party applications or software that integrate with the Keter Website. 

Age Limitations 

The Keter Website is not directed at individuals under the age of 18 or such other age designated as the age of majority by applicable law (minors). We do not knowingly collect or ask for Personal Information from minors. If you learn that a minor has provided us with Personal Information, please contact us and we will take steps to delete that information. 

Notice to End Users 

When you use the Keter Website through an organization (e.g. your employer), that organization may have access to certain information, such as username or training course completion. Please contact your organization for more information. 

Changes to this Privacy Policy 

We invite you to regularly visit this Privacy Policy in order to acquaint yourself with the latest, updated version of the Privacy Policy, so that you may remain constantly informed on how collect and use Personal Information.
